Federal Way police officer ends up caught in a crossfire

A man who was not charged with discharging a firearm sped away, claiming he was being shot at and did not know police wanted him to stop.

A Federal Way police officer ended up in between two parties shooting at each another, which led to a male speeding away from the scene and ultimately being charged with multiple felonies.

According to charging documents, a Federal Way Police Department officer was responding to a call Oct. 16 as he drove near the intersection of Weyerhaeuser Way South and 33rd Place South when heard a volley of bullets coming from the east of him, and he believed he was being shot at.

The officer then saw a black Dodge Charger driving away from where he believed the bullets were coming from. The vehicle would later be discovered as allegedly stolen and was being driven by a 19-year-old Seattle man.

The officer then aired this information over his police radio. Another officer spotted the Charger and attempted to pull it over, but the Charger sped away and ultimately got to the 1700 block of S. 320th Street. The vehicle struck the passenger’s side of a pickup truck, then a street sign, and came to a stop on the north sidewalk of S. 320th Street, according to documents. The man then ran away, ensuing a foot pursuit before police tackled him.

After the man was apprehended, it was discovered that the Charger he was in was stolen out of Seattle, and he had a Glock 23 inside the vehicle with a “switch” that allows the pistol to fire several rounds rapidly in fully automatic mode by pulling the trigger only one time, altering the firearm to be classified as a machine gun. The man was then charged in King County Superior Court on Oct. 18 with possession of a stolen vehicle, attempting to elude a pursuing police vehicle, unlawful possession of a machine gun, and hit and run of an attended vehicle, according to documents.

According to the charging documents, the officers chased the suspect, gave him several verbal commands to stop, and advised him he was under arrest. The suspect then ran a short distance and slipped on wet grass, allowing an officer to catch up to him and tackle him.

“As they were handcuffing him he said, ‘I swear to God I didn’t do nothing, I got shot at!’ He also said he didn’t know the officers were behind him. The male verbally identified himself to the officers, which they verified by viewing his Washington State ID card photograph,” documents said. “He was advised of his Miranda Rights and, post advisement, stated the Charger belonged to his friend, although he could not tell officers his friend’s name. He also later said it actually was his friend’s cousin’s car, whom he also could not name. He said he had been in Federal Way ‘doing Uber’ and that he was the only person in the Charger, but said he did not know the police were trying to stop him and couldn’t see their lights or hear their sirens.”

The documents said as the suspect was being arrested, other officers searched the area where they believed the shots had originated and located fired cartridge cases littering the ground in front of 3106 S. 337th St. The cartridges consisted of 16 7.62 caliber cases stamped with “300blk” and three .40 caliber cases stamped with “40 S&W.”

The officers then found a .40 caliber Glock model 23 handgun with an extended magazine and a red dot sight, and a second litter of fired cartridges consisting of .40 caliber and 9mm cases at 3098 S. 337th St. Officers then learned that the home at 3098 S. 337th St. was rented out through Airbnb as a short-term rental, and it seemed as if a party was happening at the home.

After further investigation, police found that the officer’s vehicle that was being shot at had bullet impacts from east and west.

The suspect pleaded not guilty and posted his $50,000 bond three days after his arrest on Oct. 19.
