The Federal Way City Council will hear two separate ordinances on recreational and medical marijuana-related businesses at the council meeting Tuesday night.

The council is expected to vote on temporarily banning medical marijuana businesses in the city for one year. But they will also hear the first reading of an amending ordinance that would allow marijuana-related businesses in two types of city zones — community business (BC) and commercial enterprise (CE) zones — after the current moratorium is lifted on May 5.

They’re expected to vote on that amending ordinance at an April 7 regular council meeting.

The ordinances come after the council extended a citywide six-month moratorium on all marijuana-related businesses on Oct. 21, 2014, which took effect on Nov. 24. This was the second moratorium after the council enacted a year-long ban on the businesses on Nov. 5, 2013.

The Planning Commission recommended the council ban marijuana-related businesses on Sept. 17, 2014 and the Land Use and Transportation Committee also voted to forward marijuana business prohibition to the council. But when it was time for the council to vote in October, the majority agreed there wasn’t enough information for council members to make a decision and the moratorium was extended.

After a Feb. 17 study session on recreational marijuana businesses, the council will need to make a decision before May 5 or the moratorium will expire and all zones will be available for marijuana retail, processing and producing businesses as long as they follow the Washington State Liquor Control Board’s 1,000-foot buffer between schools, playgrounds, recreation centers, child care, parks, public transit centers, libraries and game arcades.

Currently, the city of Federal Way has 15 marijuana retail applicants, however, per state law, only five are allowed in Federal Way. Four business owners have applied for marijuana-producing licenses and three of those four have also applied for processing licenses.
